BY ENTERING, YOU AGREE TO THESE OFFICIAL RULES, WHICH INCLUDE INDEMNITIES TO THE SPONSOR AND LIMITATIONS TO YOUR RIGHTS AND REMEDIES.
SPONSOR: The Mohawk Valley Charitable Lunch Club Giveaway (the “Giveaway”) is sponsored by the Mohawk Valley Charitable Lunch Club, PO Box 212, New York Mills, NY 13417-0212 (“Sponsor”). The Organization is a 501(c)(3) not-for-profit institution.
GIVEAWAY PERIOD: The Giveaway begins at 12:01am ET on May 27, 2019 and ends at 1:00 pm ET on December 14, 2019 (the “Entry Period”). The Sponsor is responsible for tracking receipt of entries. Entries received after the deadline will be deemed invalid. This Giveaway is governed exclusively by federal and state law within the United States.
PRIZE: One (1) Prize will be awarded. Winner will be selected via random drawing. Winner will receive one (1) 2020 Harley Davidson Street Glide. Any Entrant selected as a potential winner must comply with all terms and conditions set forth in these Official Rules and winning is contingent upon fulfilling all such requirements. In the event that the specific prize advertised is damaged or destroyed before it is awarded to the winner, the winner will be awarded a substitute cash prize of $10,000.
ELIGIBILITY: The “Giveaway” is open to legal residents located in the United States and the District of Columbia, except for Hawaii and Alaska, and who are eighteen (18) years of age or older. Employees, officers, and directors, including immediate family members (e.g. spouse, parent, child, sibling, and their respective spouses, regardless of where they reside) and members of the same household, whether or not related, of the Mohawk Valley Charitable Lunch Club (“Sponsor”) are not eligible. The “Giveaway” is subject to all applicable federal and state laws, including local laws, rules and regulations. Noncompliance with any of the Official Rules may result in disqualification.
HOW TO ENTER: Donations are not tax-deductible contributions. One (1) ticket equals one (1) entry into the Giveaway. During the Giveaway, an eligible Entrant (“Entrant”) may enter the Giveaway “in-person”, online, or via postal mail under the following circumstances by making a donation in the amount of: three (3) tickets for $50.00; nine (9) tickets for $100.00. It is not necessary for an Entrant to retain a ticket stub to claim a prize. No purchase or donation necessary to win. Sponsor and its agents are not responsible for lost, late, misdirected, damaged, incomplete, illegible or postage-due entries or Internet technical, hardware, software, telephone or transmission failures of any kind, which may limit a person’s ability to enter the Giveaway. Sponsor and its agents are not responsible for any injury or damage to Entrants’ or any other person’s computer related to or resulting from entering or downloading any materials in the Giveaway. Sponsor reserves the right to cancel or suspend advertising the Giveaway on the Internet should a computer virus, unauthorized intervention or other cause corrupt the integrity of proper conduct of the Giveaway. Sponsor revers the right to terminate or modify the Giveaway or online portion thereof, if, any time, Sponsor’s online service is no longer available or compromised by any virus, bug or other intervention beyond the Sponsor’s control. Sponsor reserves the right to disqualify any Entrant found to be disrupting the operation of the Giveaway. If the integrity of the Internet portion of the Giveaway is compromised in any manner, Sponsor reserves the right to modify and randomly select a winner from valid entries received that are unaffected by the problem. In the event of a dispute as to the identity of any online Entrant, Entrant will be deemed the individual named first on the online entry. All submissions become property of the Sponsor and will not be returned.

“IN-PERSON” OFFICIAL ENTRY WITH DONATION OPTION: A person may enter “in-person” by locating the Mohawk Valley Charitable Lunch Club display at any Mohawk Valley Charitable Lunch Club Events “Sponsor Event(s)” advertised on the Sponsor’s website (www.mvlunchclub.com) in relation to the giveaway and submitting an official entry form provided by a Sponsor representative at the Mohawk Valley Charitable Lunch Club Display. Each official In-Person entry form must include Entrant’s first and last name, complete address including zip code, telephone number, email address (if applicable), age, and donation total. The Sponsor is not responsible for lost, damaged, stolen, illegible, incomplete or late entries. By completing the In-Person official entry form, the Sponsor is authorized to use and retain the official entry information for all Entrants. Mohawk Valley Charitable Lunch Club reserves the absolute right, at any time, to amend and/or revise the list of Sponsor events posted on the Sponsor’s website.

ONLINE OFFICIAL ENTRY WITH DONATION OPTION: A person may enter online by completing and submitting the online entry form available on the Sponsor’s homepage (www.mvlunchclub.com). Each online entry must include Entrant’s first and last name, complete address including zip code, telephone number, email address (if applicable), age, and donation amount. By completing the online entry form, the Sponsor is authorized to use and retain the official entry information for all Entrants. All online entries must be received by December 14, 2019.

POSTAL MAIL OFFICIAL ENTRY WITH DONATION OPTION: A person may enter via postal mail by completing and submitting a printed official entry form available on the Sponsor’s homepage (www.mvlunchclub.com) or completing and submitting the following information on an index card: Entrant’s first and last name, complete address including zip code, telephone number, email address (if applicable), age, and donation total to the Mohawk Valley Charitable Lunch Club, PO Box 212, New York Mills, NY 13417-0212 Attn: Mohawk Valley Charitable Lunch Club Giveaway. By completing the postal mail entry form, the Sponsor is authorized to use and retain the official entry information for all Entrants. All postal mail entries must be postmarked by December 1, 2019 and received by December 6, 2019.

NO DONATION NECESSARY OPTION: A person may enter via postal mail without a donation by completing and submitting the following information handwritten on a 2 5/8’’ x 1” entry form on grey 67 lbs. cover stock paper: Entrant’s first and last name, complete address including zip code, telephone number, email address (if applicable) to the Mohawk Valley Charitable Lunch Club, PO Box 212, New York Mills, NY 13417-0212 Attn: Mohawk Valley Charitable Lunch Club Giveaway. By completing the postal mail entry form, the Sponsor is authorized to use and retain the official entry information for all Entrants. All postal mail entries must be postmarked by December 1, 2019 and received by December 6, 2019. Limit of one (1) entry per envelope per household.
GIVEAWAY EVENT: Odds of winning depend on the total number of eligible entries received. The potential winner of the Giveaway will be selected by random drawing following the Giveaway End Date from the eligible entries received by the official receipt date of December 14, 2019. Drawing will be conducted under the supervision of independent judges (“Giveaway Drawing Event”) in Utica, New York on December 15, 2019 at 2:00pm. The drawing will be conducted under the direction of independent judge(s) whose decisions are final on all matters relating to the contest.
Subject to verification of eligibility and compliance with the terms of these Official Rules, the potential winner will be declared the official winner of the Giveaway. The potential winner will be required to submit his/her valid social security number and/or other identification to Sponsor and may be required to execute, have notarized and return an Affidavit of Eligibility and Release of Liability and, unless prohibited by law, publicity. Failure to submit any identification required by Sponsor; failure to return the required documents within the specified time period; noncompliance with these Official Rules; or failure to accept the Prize by predetermined deadlines may result in Entrant disqualification and Prize forfeiture. Such disqualification and forfeiture may, at Sponsor’s sole discretion and time permitting, cause an alternate potential winner to be randomly selected from among all remaining eligible Entrants.
PRIZE NOTIFICATION: Prize notification will be issued upon preliminary eligibility verification by the Sponsor. The winner will be notified by a telephone call, e-mail, and/or a letter sent via first class US Mail from the Mohawk Valley Charitable Lunch Club specifying that the winner must contact a specific official at the Mohawk Valley Charitable Lunch Club.
PRIZE NOTIFICATION RESPONSE REQUIREMENTS: The winning Entrant must respond to the issuance of prize notification by e-mail and/or by signed letter within five calendar days of the first attempted delivery of the letter at the address provided by winning Entrant. If any Entrant selected as a winner cannot be contacted by the fifth business day at 5:00pm eastern standard time (EST); if the Prize Notification is returned as undeliverable; if a winner rejects their Prize; or if the winner fails to comply with the all eligibility requirements and the Official Rules, such Prize will be forfeited and the Sponsor has sole discretion to determine the manner in which an alternate winner may be selected from the remaining entries.
PRIZE CONDITIONS: All Prize details are determined at the sole and absolute discretion of Sponsor. All costs and expenses associated with Prize acceptance, possession and use not specified herein as being provided, are the sole responsibility of the winner. Winner is fully responsible for any and all applicable federal, state, territory, provincial and local taxes (including income and withholding taxes). The Prize is non-transferable and non-assignable, with no cash redemptions except at Sponsor’s sole and absolute discretion. The Sponsor will not award any value in excess of the value listed in the Official Rules.
PRIZE ACCEPTANCE: Once the winning Entrant’s prize notification response has been received and verified, winner must complete and execute Mohawk Valley Charitable Lunch Club’s Affidavit of Eligibility for and Prize Acceptance and Liability/Publicity Release form within ten (10) days. The winning Entrant is solely responsible for all expenses, including federal, state and local taxes, insurance, licensing, registration, and title fees related to and/or for the prize. Mohawk Valley Charitable Lunch Club is not responsible for any unauthorized human intervention or other causes outside of its control which compromises the administration, security, or conduct of the Giveaway.
LIMITATIONS ON LIBAILITY: Upon acceptance of the prize, the winning Entrant forever releases from any and all liability, loss, harm, damage, cost or expense, regardless of how it was incurred, and including without limitation, any and all claims for property damage, personal injury, and/or death which may occur in connection with the winner’s acceptance, ownership, possession and/or use of the prize, each of the following: Sponsor, and all of their respective officers, directors, employees, representatives and agents.
CONTEST RULES: All contest Entrants consent to the Official Rules and the processes and procedures outlined in such Official Rules. By accepting these Official Rules, the winning Entrant expressly authorizes the Mohawk Valley Charitable Lunch Club and its employees, agents, and representatives’ use of their name, address, and/or their photograph and/or likeness for publicity or advertising purposes without further compensation or permission, except where prohibited by law. All forms, documents, follow-up communications, and recorded information regarding the In-person, online, phone and postal mail Entrants are the exclusive property of the Mohawk Valley Charitable Lunch Club, which will not be returned.
CONTEST RESTRICTIONS: If any laws or restrictions apply to any valid contestant, participant, and/or winning Entrant, the contest may be deemed void for such individuals, whether or not such information is known or unknown to all parties before or after the Giveaway is finalized. Entrants determined to be void are unable to participate and/or claim the Prize. The Mohawk Valley Charitable Lunch Club shall not be held responsible for resolving potential or actual claims of void Entrants.
WINNER ANNOUNCEMENT: The winning Entrant will be posted online on the Mohawk Valley Charitable Lunch Club’s website at (www.mvlunchclub.com) once the winner’s eligibility process has been finalized and the winner has accepted and taken possession of the Prize. Identification of the winning Entrant will also be available 15 calendar days after the winning Entrant has taken possession of the prize. Written requests for winner identification information should be sent to the mailing address noted below. All requests must include a self-addressed, stamped envelope.
All issues and questions concerning these Official Rules, or the rights and obligations of the Entrant and Sponsor in connection with the Sponsorship, shall be governed by, and construed in accordance with, the laws of New York State, without giving effect to any choice of law or conflict of law rules (whether of New York State or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than New York State.
